Family cases must be decided in 6 months
PLJ 2014 · Lahore High Court
This case involved a dispute between a wife, Mehwish Gillani, and her husband over dower (Haq Mehr) and maintenance. She had filed a family court suit in Multan for recovery of these amounts. Her husband separately filed a civil suit in Islamabad challenging certain entries in their Nikah Nama (marriage contract), though he did not deny the marriage itself. When that civil suit was dismissed and then appealed, the Family Court judge in Multan used the pending appeal as a reason to stay the wife's dower claim, even though the Lahore High Court had earlier directed him to decide the whole case within two months without being distracted by side issues.
The Lahore High Court found this improper. It held that family court cases, especially those involving maintenance and dower, must be decided quickly and cannot be stalled simply because a related civil suit is ongoing elsewhere, since civil litigation can drag on for years while family law matters are meant to be resolved within six months under the Family Courts Act. The Court also emphasized that family court judges are subject to its supervisory authority and cannot bypass clear directions by citing orders from another High Court.
This ruling matters because it reinforces that family courts cannot indefinitely delay cases, particularly those protecting women's rights to dower and maintenance, by letting unrelated civil disputes dictate their pace.
