Denial of Relationship in a Family Suit

PLJ 2014 · Islamabad High Court

This case involved a dispute over whether a family court or a civil court had the authority to decide a marriage case. A woman had filed a suit for dissolution of marriage, claiming to be the wife of the petitioner. In his written response, the petitioner denied that any marriage existed between them and argued that since there was no valid marriage to dissolve, the Family Court had no jurisdiction to hear the case at all - he claimed such a dispute should go to a civil court instead.

The Family Court rejected this objection and proceeded with the case, prompting the petitioner to challenge that decision before the Islamabad High Court.

The High Court ruled against the petitioner. It explained that when one spouse denies the existence of a marriage, this is legally called "jactitation of marriage," and Pakistani law specifically places such disputes within the exclusive jurisdiction of the Family Court, not the civil courts. The court distinguished this situation from cases the petitioner cited, which involved disputes over inheritance where a third party (not one of the spouses themselves) questioned whether a marriage had existed. In those situations, civil courts were appropriate because the people disputing the marriage weren't the spouses themselves.

Since this case was a direct disagreement between two people claiming to be spouses, the Family Court was the correct venue. The petition was dismissed, meaning the case would continue in the Family Court as originally decided.
