Decree of Khula on unregistered Nikahnama

PLJ 2014 · Sindh High Court

This case from the Sindh High Court dealt with a husband's challenge to an ex-parte khula (wife-initiated divorce) decree granted by a Family Court in favor of his wife.

The wife had filed for dissolution of marriage, stating the Nikah was unregistered, that her Haq Mehr (dower, fixed at two tolas of gold) was never paid, and that her husband mistreated and eventually expelled her. The husband did not appear in court despite being summoned through multiple means, including newspaper publication, so the Family Court granted the divorce in his absence. The husband later challenged this in the High Court, claiming the Nikahnama was actually registered, that he was condemned unheard, and that the law required restoration of dower before khula could be granted.

The High Court dismissed the husband's petition. It held that the law requiring return of Haq Mehr applies only when the wife herself offers to surrender it in exchange for an expedited khula decree. Since the wife's dower was never paid to her in the first place, there was nothing to restore, and no violation occurred. The court also noted that the husband already had a pending application before the Family Court to set aside the ex-parte decree under the Family Court Rules, making the High Court petition premature and not maintainable. Any dispute about property allegedly transferred to the wife would have to be resolved separately in civil court.

This ruling clarifies that dower restoration rules protect husbands only when wives voluntarily give up already-received dower for quick khula, not in every khula case.
