Wife cannot be forced to live with her husband
PLJ 2014 Cr.C. ( · Sindh High Court
This case involved a habeas corpus petition under Section 491 of the Criminal Procedure Code, filed by a husband who claimed his wife, Mst. Shaista, was being wrongfully confined by her brothers. He said he had married her, was pressured by his own family into signing divorce papers, but insisted he never actually pronounced the divorce, making it invalid under religious rulings he obtained. The brothers countered that a valid divorce had indeed taken place and been formally conveyed.
The Sindh High Court, however, found that it could not resolve the dispute over whether the divorce was valid within a habeas corpus proceeding, since that required separate legal determination. Instead, the court focused on what it could decide: the woman's personal liberty. Since Mst. Shaista was an adult (sui juris) capable of managing her own affairs, she could not be forced to live with her husband, her brothers, or be kept in a shelter home (Darul Aman) against her wishes. The court explained that under Islamic law, a woman cannot be compelled to live with her husband if she disagrees, and her husband's only recourse would be to file a separate suit for restitution of conjugal rights.
The court ultimately ordered that she be set free to live wherever she chose, emphasizing her constitutional right to liberty under Article 9. This case matters because it reinforces that adult women have the legal right to make their own choices about where and with whom they live, regardless of pressure from husbands or family members.
