A Sui Juris Woman cannot be kept in Darul Aman against her consent

PLJ 2014 Cr.C. (Karachi) 327 · Sindh High Court

This case involved a habeas corpus petition filed by a husband asking the court to recover his wife, Mst. Shaista, whom he claimed was being wrongfully confined by her brothers. He said he had married her with family consent, was later pressured by his own parents to divorce her, signed a divorce paper under duress but never actually pronounced the divorce, and later obtained religious opinions supporting that such a forced divorce was invalid. The wife's brothers disputed this, claiming the husband had validly divorced her and that he was now harassing the family.

The Sindh High Court held that it could not, in a habeas corpus proceeding, determine whether the divorce was legally valid or effective, since that required separate legal proceedings. Instead, the court focused on the woman's own wishes. Since she was an adult, mentally competent woman ("sui juris"), the court ruled she could not be forced to live with her brothers, her husband, or in a shelter home (Darul Aman) against her will. Citing earlier Supreme Court precedents, including the Rinkle Kumari case, the judgment emphasized that a major woman has full legal capacity to decide her own future, and Article 9 of the Constitution guarantees personal liberty, meaning no one can be detained without consent. The court ordered her release to live wherever she chose, with police protection if needed. The case reinforces that courts must respect an adult woman's autonomy over disputes about marriage, custody, or shelter.
