All owners in Shamlat Deh land are necessary party to the suit
PLJ 2014 AJ&K 267 · Azad Jammu & Kashmir High Court
This case involved a long-running dispute over forest land in Village Sehr Mandi, District Kotli, which was originally government-owned "crown land" (Khalsa Sarkaar). A plaintiff, Muhammad Sabir, claimed that this land had been converted into communal village land (Shamlat Deh) through a mutation entry, and that forest department entries in the revenue record claiming the land as forest were wrong. In 2000, the trial court issued a consent decree in favor of Sabir and another person, declaring them owners. The Forest Department and other parties appealed, and the appellate court set aside this consent decree and sent the case back for fresh trial. Both sides then approached the High Court.
The High Court upheld the appellate court's decision to overturn the consent decree. It found that such decrees transferring crown land or Shamlat Deh land through sale, gift, or private compromise, without including all necessary parties, are not valid in law. It also noted that disputes about correcting revenue records concerning crown land fall outside the jurisdiction of civil courts. Importantly, the court held that when crown land becomes village common land (Shamlat Deh), all landowners of that village are necessary parties to any suit concerning it—not just select individuals. Since the original case excluded other village landowners, the decree could not stand. This ruling reinforces protections against improper private deals over public and communal land.
