Wrong transfer of Shares in Property
PLJ 2013 · Peshawar High Court
This case from the Peshawar High Court dealt with a family dispute over inheritance shares under Islamic law. The petitioners claimed they were descendants of a woman named Zeenat Bibi, daughter of the late Syed Rasan, and that they were entitled to their rightful shares in his estate (legacy). However, the entire property had been wrongly transferred into the names of Syed Rasan's two sons, cutting out the daughters' descendants from their inheritance.
The trial court had initially ruled in favor of the petitioners, but an appellate court reversed that decision and dismissed their case. The petitioners then brought this revision petition to the High Court.
The High Court held that under Sharia law, rightful heirs cannot be denied their due inheritance shares once their blood relationship to the common ancestor is established. It clarified that the petitioners' mother was entitled to a 1/6 share in Syed Rasan's estate, and each petitioner (as her children) was entitled to a 1/12 share. The court also addressed inheritance from another deceased relative, Mst. Zain Noora, directing how her share should be distributed among her nieces and other heirs.
Ultimately, the court found no legal error in the appellate court's judgment and dismissed the revision petition. This case highlights how Pakistani courts apply Islamic inheritance principles to ensure legal heirs, including women and their descendants, are not deprived of their rightful shares through improper property transfers.
