What is case of sudden arrest?

PLJ 2013 · Peshawar High Court

This case involved an appeal against a conviction under Pakistan's Arms Ordinance, 1965. The appellant, Naik Amanullah Khan, had been found by police patrolling an area in Karak carrying two Kalashnikov rifles with ammunition, without any valid license. He was arrested on the spot, and the weapons were seized and documented. He was later convicted by a trial court and sentenced to three years' rigorous imprisonment with a fine, though because he was young and a first-time offender, the court showed leniency and placed him on probation instead of requiring him to serve time in custody.

He appealed to the Peshawar High Court, arguing the conviction was flawed. The High Court reviewed the testimony of the police officers involved, including the officer who made the arrest, a witness to the seizure, and the investigating officer who obtained an expert report confirming the weapons. The court found their testimony consistent, credible, and unshaken by cross-examination, with no evidence of bias or personal grudge against the appellant. It reaffirmed the legal principle that police officers are valid witnesses just like ordinary citizens, and their evidence shouldn't be dismissed simply because they work for the police.

The court concluded this was a case of sudden, on-the-spot arrest rather than a pre-planned raid based on prior tip-off, and that the prosecution had proven its case convincingly. Finding no error in the trial court's judgment, the High Court dismissed the appeal and upheld the conviction and probation.
