Warid Telecom etc. Versus PTA
PLJ 2013 · Islamabad High Court
This case involved Warid Telecom and four other cellular companies challenging a directive issued by the Pakistan Telecommunication Authority (PTA) on 9 April 2012, which ordered all mobile operators to immediately suspend prize schemes and promotional offers for customers.
The telecom companies argued that the directive was issued without giving them a hearing, violating principles of natural justice, and that it contradicted PTA's earlier decision from 2010 which had allowed such schemes to continue under certain conditions. They also claimed the order was discriminatory since it targeted only cellular operators and not other service providers, and that it wrongly banned even genuine, legitimate schemes along with fraudulent ones.
PTA defended its directive by explaining that it had received widespread complaints of fraud, where dishonest elements were deceiving customers through fake calls and SMS messages promising cash prizes, balance top-ups, and credit transfers under the guise of these promotional schemes.
The Islamabad High Court dismissed the petitions and appeals. It held that the companies had failed to prevent misuse of their own systems by fraudsters, and could not claim a right to continue schemes when the public was being harmed. The court found that the constitutional right to conduct business under Article 18 is not unlimited, and that consumer protection took priority. Since the companies had not shown they complied with PTA's earlier directives in good faith, they could not now demand relief.
This ruling matters because it reinforces that regulatory bodies can restrict business practices to protect consumers from fraud,
