The person filing case must be affected by it

PLJ 2013 · Azad Jammu & Kashmir High Court

This case from the Azad Jammu and Kashmir High Court dealt with a challenge to a government notification that reserved MBBS medical college seats for certain categories, including overseas Kashmiris and children of doctors. A group of petitioners argued that this reservation created a privileged class, discriminated against ordinary citizens, and violated constitutional guarantees of equality before the law under the AJ&K Interim Constitution Act, 1974.

The respondents countered that the petitioners themselves had applied for and secured seats under the general district-wise quota, and had not shown that they personally suffered any loss or deprivation of rights due to the reserved quotas for doctors' children and overseas Kashmiris. They argued the petition was essentially academic and that courts do not entertain such petitions unless the person challenging a law is genuinely affected by it.

The court agreed with the respondents. It held that to invoke the High Court's writ jurisdiction, a petitioner must be an "aggrieved person" with a real, tangible interest at stake. Since the petitioners had not shown how they were personally harmed, and had not even sought to amend their petition to include those who might be affected, the court could not grant relief without hearing the students who had actually been admitted under the challenged notification.

The petition was therefore dismissed, though the court directed the government to review the notification and give it proper legal backing. The case reinforces the important legal principle that courts generally only intervene when a petitioner has a direct stake in the outcome.
