Reference to High Court in a case decided by Member Customs Appellant Tribunal
PLJ 2013 Tax Cases (Kar.) 119 (DB) · Not specified
This case involved a Toyota Land Cruiser Jeep that had been registered with the Motor Vehicle Registration Authority in Karachi back in 1996. In 2005, customs officials intercepted the vehicle and seized it, alleging it was smuggled because one of the documents produced by its owner, a photocopy of a Bill of Entry, did not actually match the vehicle when customs checked their records. The vehicle was confiscated, though the owner was given the option to pay a redemption fine plus duties and taxes to get it back. The case went through multiple rounds of appeals, including to the Supreme Court, which sent it back to the Customs Appellate Tribunal for a fresh decision. The Tribunal again ruled against the vehicle owner, prompting this reference to the High Court.
The High Court ruled in favor of the applicant (the vehicle owner). It found that the registration authority had already verified the vehicle's registration as genuine, and the customs authority had never properly checked whether the registration itself was lawful or whether the documents were fake. Since the owner had produced several genuine-looking documents, including the original registration book and proof of duty payment, the burden of proof shifted to the customs authority to prove the vehicle was smuggled, under Section 187 of the Customs Act. The Tribunal had ignored this and relied on guesswork instead of evidence.
This case matters because it reinforces that once a vehicle owner provides reasonable documentation, authorities bear the responsibility of proving smuggling with solid evidence, not assumptions.
