Judgment on S.R.O 499(I)/2009 dated 13-06-2006
PLJ 2013 Tax Cases ( · Islamabad High Court
This case concerns a dispute over imported goods (described as Polypropylene) where customs authorities had allegedly mis-declared the goods' value and quality, and imposed a fine in lieu of confiscation based on rates set out in a government regulation, S.R.O. 499(I)/2009. The importer, Global International, challenged this regulation before the Sindh High Court, arguing that the Federal Board of Revenue did not have the legal authority to fix such fines, since the relevant provision of the Customs Act (Section 32) had been excluded from Section 15 after an amendment made through the Finance Act, 2011. The importer wanted the regulation struck down and the goods released.
During the hearing, the petitioner's lawyer conceded that the regulation had actually been issued before the 2011 amendment, at a time when the FBR did have the power to set such fines. So the original challenge could not succeed. Instead, the lawyer asked for an alternative relief, arguing that after the 2011 amendment, the regulation's provisions had become ineffective and should not be applied going forward.
Since the importer already had an appeal pending before the Collector of Customs (Appeals) against the original order, the court did not decide this new legal argument itself. Instead, by agreement between both sides, the court disposed of the petition and directed the importer to raise this specific legal argument before the Collector of Customs (Appeals), who was instructed to consider it and decide the appeal on merits within a reasonable time.
