Judgment on Recovery Proceedings by Customs Authorities
PLJ 2013 Tax Cases ( · Not specified
This case involves Dewan Cement Limited, which challenged customs authorities' attempts to recover outstanding duty and taxes from the company. The customs department had issued a warrant of attachment to recover about Rs. 86.8 million in unpaid dues.
The company's dispute over this demand was already pending before the Customs Appellate Tribunal, which had earlier refused to stay the recovery and instead ordered the company to deposit the amount within 15 days via a bank guarantee. When the company failed to comply, it went to the High Court instead, which also ordered it to submit a bank guarantee for 50% of the demand. The company again failed to comply with this order too.
Rather than following either the Tribunal's or the Court's directions, the company filed yet another petition, this time also claiming it was entitled to sale proceeds from its own goods that customs had auctioned, asking for these to be refunded or adjusted against its tax liability.
The High Court found that the company had repeatedly ignored binding orders from both the Tribunal and the Court itself, seemingly to avoid paying its admitted tax liability altogether. It held that such conduct was dishonest and contemptuous, disqualifying the company from receiving any discretionary relief under the Court's constitutional jurisdiction. Since there was no valid stay order protecting the company and it had failed to honor the consent order, the Court dismissed the petition. This case underscores that courts will not reward parties who disregard prior judicial directions while seeking fresh relief.
