Suspension of Sentence on Medical Ground

PLJ 2013 · Lahore High Court (Multan Bench)

This case involved a petition before the Lahore High Court (Multan Bench) seeking suspension of sentence and bail for a convicted prisoner named Yasin, pending the outcome of his criminal appeal. Yasin had been convicted by a trial court for house-trespass and kidnapping/abduction offenses and sentenced to seven years' imprisonment and life imprisonment respectively, to run concurrently.

The petition was filed on medical grounds, as Yasin was suffering from AIDS. Two other petitioners initially named in the case, Zafar and Ashiq Hussain, were dropped from the petition by their own counsel and their case was dismissed as not pressed.

The court examined medical reports from jail and hospital doctors. These showed that Yasin's health was steadily worsening - he had lost over 15 kg in weight, suffered recurring critical episodes requiring hospital transfers, and needed continuous specialist supervision that the jail could not provide. The state opposed the petition, arguing adequate treatment was available in jail, but the court found the medical evidence persuasive.

The court accepted the petition, suspended Yasin's sentence, and ordered his release on bail with bond conditions, pending final decision of his appeal.

This judgment matters because it illustrates how courts can use their discretion under Section 426 of the Criminal Procedure Code to suspend sentences when a prisoner's serious illness cannot be adequately managed within jail facilities, balancing humanitarian medical concerns against the state's interest in enforcing pun
