Who can file suit for Jactitation of Marriage?

PLJ 2013 SC (AJ&K) 58 · Azad Jammu & Kashmir High Court

This case concerned a dispute over an allegedly fake marriage (jactitation of marriage), where one party, who lived in England, sued to have a marriage between the appellants declared forged and fraudulent, and sought an order preventing one defendant from claiming the other as his wife.

The appellants challenged the case on several technical grounds: that certain photostat (photocopied) documents, including a divorce deed and certificates, had been wrongly relied upon despite not being properly proven in court; that the suit was filed in the wrong location since the plaintiff lived abroad; that the lawsuit was filed before the power of attorney authorizing it was even signed; and that only a wife, not a husband, is legally allowed to bring such a suit.

The Supreme Court of Azad Jammu and Kashmir rejected these objections. It held that photocopied documents cannot be relied upon as evidence unless properly proven, and the people who attested them had not testified in court. It ruled that minor procedural issues, like the plaint being signed by a lawyer rather than the plaintiff personally, do not invalidate a case unless the law specifically says so. Importantly, the court clarified that a suit for jactitation of marriage is not limited to wives alone; husbands, wives, or even third parties can file such suits, and Family Courts have exclusive jurisdiction over them.

This judgment is significant because it clarifies who can legally challenge a disputed marriage and confirms that courts should focus on substantive justice rather than rejecting cases over technical defects.
