Proceedings for attachment of Property

PLJ 2013 SC (AJ&K) 305 · Azad Jammu & Kashmir High Court

This case involved a family property dispute between co-sharers (described as sisters and their representatives) who were fighting over possession of a house in Kotli. After police reported possible breach of peace, a magistrate attached (took control of) the disputed property under Section 145 of the Criminal Procedure Code, appointing a receiver to manage it. This order was upheld by the Sessions Judge but later challenged before the High Court, which quashed it. The matter then reached the Supreme Court of Azad Jammu and Kashmir.

The Supreme Court upheld the High Court's decision and dismissed the appeal. It found that the magistrate had attached the property without properly applying his mind or following the legal requirements of Section 145. The police report did not show any real emergency justifying attachment, and the magistrate failed to hold a proper inquiry before acting. The court also noted that since the magistrate had already taken action to prevent breach of peace under separate provisions (Sections 107, 150, 151), that concern had effectively been addressed, making the attachment unnecessary. Additionally, the court observed that when a civil court is already handling a property dispute, criminal attachment proceedings become largely unnecessary, since civil courts have broader powers to protect property during litigation.

This ruling matters because it reinforces that magistrates cannot attach property as a matter of routine or convenience, they must genuinely assess whether an emergency exists, and it clarifies the relationship between civil and criminal proceedings over the same property dispute.
