Compulsory Retirement of a Civil Servant
PLJ 2013 SC 834 · Lahore High Court
This case concerns a police constable, Tariq Mahmood, who was dismissed from service in 1992 after being implicated in a criminal case involving fraud and forgery charges. He was also briefly absent from duty around the same time. He filed a departmental appeal and later a revision petition, but the revision was kept pending for roughly 17 years while the related criminal case and a civil suit were decided. He was eventually acquitted of the criminal charges in 2010, and his revision petition was then allowed, meaning his dismissal was effectively reversed.
The dispute before the Supreme Court was whether he was entitled to back pay and benefits for the long period he was out of service, and whether the Punjab Service Tribunal had wrongly modified his punishment.
The Supreme Court held that a person is presumed innocent until proven guilty, so the department could not deny him benefits merely because of a pending criminal case. It ruled that reinstated employees are normally entitled to back benefits unless proven to have been gainfully employed elsewhere during that period. Since the long delay in deciding his revision petition was caused by the department, not by him, he could not be blamed for it. The Court directed a committee to calculate his entitlement, excluding only the short period of unexplained absence, and dismissed the department's appeal.
This case matters because it reinforces that civil servants should not suffer financially due to delays caused by the government's own administrative processes, and it clarifies principles on reinstatement and back-pay entitlements.
