Transaction with Pardanesheen Ladies
PLJ 2013 SC 37 · Lahore High Court
This case was about a disputed land sale agreement dating back to 1966, allegedly signed by several pardanasheen (secluded, illiterate) women. A buyer sued for specific performance of the sale agreement, claiming the women had agreed to sell land to him, while later purchasers of the same land, including the appellant, disputed the validity of that original agreement.
The central legal issue was whether proper procedures had been followed in verifying that the women actually understood and consented to the transaction, as required under Section 38 of the Registration Act and prior Supreme Court precedent (Janat Bibi v. Sikander Ali). Witnesses who were supposed to confirm the women's identities and execution of the document gave contradictory or doubtful testimony, and some denied the women's signatures or thumb impressions were genuine.
The Supreme Court held that when pardanasheen women are involved in a transaction affecting their property rights, the person claiming the benefit of that transaction must affirmatively prove the women understood what they were doing and had independent advice. Since this had not been properly established, and since the lower courts had decreed the case without carefully weighing the evidence, the Supreme Court allowed the appeal, overturning the earlier decisions.
This case matters because it reinforces strong legal protections for vulnerable parties, particularly illiterate or secluded women, ensuring they cannot be bound by major property transactions without clear proof of informed consent.
