Restitution of Conjugal Rights Decree
PLJ 2013 · Lahore High Court (Rawalpindi Bench)
This case involved a husband, Muhammad Shiraz, who had filed a suit for restitution of conjugal rights against his wife, while the wife had filed her own suit seeking maintenance and enforcement of certain conditions written into their Nikah Nama (marriage contract), specifically clauses 17 and 20, which dealt with gold ornaments and a lump sum payment of Rs. 50,000 in case of desertion by the wife.
The Family Court had granted the husband's suit for restitution of conjugal rights, while also awarding the wife and daughter maintenance, but had refused her claims for the gold ornaments and the Rs. 50,000 payment. On appeal, the Additional District Judge reversed this partly and awarded her the gold ornaments and the money. The husband challenged this before the Lahore High Court.
The High Court held that since the wife had deserted the husband and a decree for restitution of conjugal rights existed in the husband's favor, the contractual condition triggering payment upon "desertion" could not be enforced against him. It also ruled that such a condition in the Nikah Nama did not qualify as an "actionable claim" under the Transfer of Property Act. However, the Court held that since the wife still legally carried the husband's name as his wife, she remained entitled to basic maintenance as an acknowledgment of that status.
The petition was therefore partly allowed, setting aside the ornaments and Rs. 50,000 award, while upholding the maintenance granted to the wife.
