Report of Handwriting Expert is an opinion
PLJ 2013 · Lahore High Court (Multan Bench)
This case involved a dispute over agricultural land in Punjab. After Sardar Ali died, his legal heirs (the plaintiffs) discovered a mutation entry showing he had supposedly gifted his land to certain other heirs (the defendants) back in 1994. The plaintiffs went to court claiming no such gift had ever actually been made, and sought to have the mutation declared invalid. Both the trial court and the first appellate court ruled against the plaintiffs, so they brought the matter to the Lahore High Court.
The High Court sided with the plaintiffs. It held that once heirs challenge a gift mutation and deny under oath that any gift occurred, the burden shifts to the people benefiting from the gift to prove it was genuine. They must show not just that the mutation was properly recorded, but that an actual gift took place, meaning a clear offer, acceptance, and handing over of possession. In this case, the defendants had not even pleaded these essential facts in their court filings, let alone proved them.
The court also addressed the two conflicting handwriting expert reports about disputed signatures on the mutation document. It ruled that expert opinions on handwriting are not binding on courts, and since the two reports contradicted each other, neither could be relied upon, leaving the witnesses' sworn testimony as the more credible evidence.
The court allowed the revision petition, overturning the lower courts' decisions because they had misapplied the law. This case matters because it clarifies that gift claims require independent proof beyond mere paperwork, and that handwriting reports are adv
