Quashment Petition in case of Tempered Vehicle
PLJ 2013 · Peshawar High Court
This case involves a dispute over the custody of a vehicle whose identity had been questioned by police. The petitioner, Iftekhar Ali, was driving a car that police stopped and seized because he could not produce valid ownership documents. An investigation revealed that the vehicle's chassis number appeared to have been tampered with, and its registration book was not genuine according to the registering authority. A criminal case was registered against the petitioner, though he was eventually acquitted of the criminal charges. However, the courts ordered the vehicle itself to be confiscated by the State rather than returned to him.
The petitioner claimed he was a genuine buyer who had purchased the car for nine lakh rupees and produced witnesses to support the sale. However, he could not produce the actual seller or the people who had prepared and witnessed the sale document, leaving key facts about the purchase unverified. Forensic reports from two laboratories confirmed the chassis number had been altered, and there was no valid transfer letter or original registration book in his name.
The Peshawar High Court held that given tampered vehicle identification, lack of genuine ownership documents, and absence of credible proof of purchase, the lower courts were right to refuse returning the vehicle and to confiscate it to the State. The petition to quash these decisions was dismissed. The case highlights that mere acquittal in a criminal case does not automatically entitle a person to recover property suspected of being linked to fraud, especially when ownership documents cannot be authenticated.
