Production of Additional Evidence to reach a conclusion

PLJ 2013 · Lahore High Court

This case from the Lahore High Court dealt with a civil dispute where the losing party in a lower court appeal tried to introduce additional evidence, including witnesses and documents like a nikah nama (marriage certificate) and certified challan forms, after the trial had concluded. The appellate court had dismissed their applications, partly on the grounds that the material was submitted too late and partly without even deciding on one of the applications. The petitioners challenged this dismissal before the High Court.

The High Court examined two main issues: an application under Order XIV, Rule 1 of the Civil Procedure Code, asking for additional legal issues to be framed to help resolve the dispute, and an application under Order XLI, Rule 27, seeking permission to submit additional evidence at the appellate stage.

The Court upheld the dismissal of the request for framing additional issues, finding no jurisdictional error there. However, it ruled that the appellate court was wrong to reject the request to produce additional documents merely because of delay. The judgment clarified that late filing alone, without evidence of bad faith, is not enough reason to refuse important evidence, especially when it could help the court reach a fair decision. It also noted that one application about producing witnesses had never actually been decided and sent that back for proper consideration.

This ruling matters because it reinforces that courts should prioritize deciding cases on their true merits rather than rejecting evidence on technical or procedural grounds alone.
