Pharmatec Pakistan, a pharmaceutical manufacturer with offices in Karachi, Multan, Rawalpindi and Peshawar, went to the National Industrial Relations Commission (NIRC) seeking relief against a workers' union, the Pharmatec Workers Welfare Union, which was certified as a Collective Bargaining Agent (CBA) in Sindh province only.
The company argued that since it operates across multiple provinces, only an industry-wise trade union registered at the federal level should represent its workers, not a provincially registered union. It also accused the union and its officials of harassment, making unreasonable demands, filing repeated complaints to pressure management, and trying to force withdrawal of a show-cause notice issued against one union official accused of making false allegations to police. The company said this amounted to unfair labour practices and sought orders restraining the union from coercive tactics, including strike threats, while a disciplinary inquiry proceeded.
The NIRC member examined the union's charter of demands and found it reflected a negative, confrontational attitude rather than reasonable, practical requests. The Commission held that while any CBA has the right to raise demands, those demands must be reasonable and feasible. It found the balance of convenience favored the company, which would suffer irreparable harm without protection, and concluded the company had established a case of unfair labour practice by the union. This case highlights how labour tribunals weigh employer rights against union demands and scrutinize whether union conduct crosses into coercion.
