No maintenance to wife if she doesnt wish to live with perfect husband
PLJ 2013 · Peshawar High Court
This case from the Peshawar High Court dealt with a woman who sought dissolution of her marriage, return of dowry items, and maintenance allowance shortly after her wedding in 2008. The marriage was never consummated. The trial court dissolved the marriage through khula (a wife-initiated divorce) because she could not prove that her husband was cruel or impotent, but she had expressed extreme hatred toward him and an unwillingness to continue living with him. Since she was the one refusing to fulfill marital obligations, the court denied her maintenance allowance. The trial court also ordered return of her dowry articles but did not require her to return gold ornaments given to her at the time of rukhsati (sending the bride to the groom's house). On appeal, the appellate court ordered that the gold ornaments be returned to the husband, since in a khula divorce where the wife is ending the marriage without fault on the husband's part, he is entitled to recover what was given as dower.
The High Court upheld both the khula divorce and the return of the gold to the husband. It reasoned that when a wife says she cannot live within the bounds set by God due to hatred for her husband, courts must grant khula even without an explicit plea, and in such cases it is fair for the husband to recover the dower he gave. This case clarifies that courts can grant khula based on the wife's expressed hatred alone, but that such wives who aren't at fault-free may lose both maintenance and retained dower.
