Jurisdiction of Banking Court

PLJ 2013 Lahore 606 · Lahore High Court (Multan Bench)

This case deals with whether a bank can file a criminal complaint when a customer's cheque, given as repayment for a loan, bounces.

A bank had given a loan to a person who issued a cheque to repay it. When the cheque was dishonoured, the bank approached a magistrate (Ex-officio Justice of Peace) asking for a criminal case to be registered against the customer under Section 489-F of the Pakistan Penal Code, which deals with dishonestly issued cheques. The magistrate ordered police to proceed with the matter. The customer challenged this order in the Lahore High Court.

The petitioner argued that since the cheque related to a bank loan, the matter fell under the special law governing banks and financial institutions, the Financial Institutions (Recovery of Finances) Ordinance, 2001, which requires such disputes to go through a specialized Banking Court, not ordinary criminal courts or police.

The High Court agreed. It held that the Ordinance is a special law that overrides the general criminal law (PPC) for matters between banks and their customers, even though Section 489-F was added to the PPC after the Ordinance.
