Intra Court Appeal against Bank of Punjab

PLJ 2013 · Islamabad High Court

This case involved a dispute over which court or tribunal had authority to hear labour-related complaints filed by bank employees against the Bank of Punjab. The employees had originally taken their grievances about unfair labour practices to the National Industrial Relations Commission (NIRC). The bank argued that after Pakistan's 18th Constitutional Amendment abolished the "concurrent legislative list," labour and trade union matters became a provincial subject, meaning such cases should be transferred to provincial labour courts and tribunals under the Punjab Industrial Relations Ordinance, 2010, rather than being heard by the NIRC, a federal body.

The NIRC had rejected the bank's request to transfer the cases, reasoning that it could still handle matters of a national, industry-wide character and that the law under which it was created had been constitutionally protected (saved) despite the amendment. However, a single judge of the High Court sided with the bank and ordered the cases transferred to the provinces. The employees then appealed this decision.

The Islamabad High Court's two-judge appellate bench ruled in favor of the employees, restoring the NIRC's jurisdiction. It held that the NIRC could continue handling cases involving unions or disputes spanning more than one province, that the 2008 law creating the NIRC was constitutionally protected as an existing law, and that newer federal legislation (the 2011 Industrial Relations Ordinance) applied retrospectively, reinforcing the NIRC's authority. This clarified which forum workers should use for cross-provincial labour

این آئی آر سی نے بینک کی جانب سے مقدمات کی منتقلی کی درخواست مسترد کر دی تھی، اس بنی
