If Dower is not paid, wife can refuse to live with husband
PLJ 2013 · Islamabad High Court
This case involved a husband and wife whose marriage broke down after the wife left the marital home in 2010, alleging mistreatment. The wife sued for her unpaid dower (a sum promised to her at marriage), maintenance allowance, and dowry articles, while the husband sought restitution of conjugal rights, meaning a court order requiring his wife to return and live with him.
Lower courts had ordered the husband to pay the dower and maintenance but disagreed on whether he was entitled to restitution of conjugal rights. The husband challenged this outcome before the Islamabad High Court, claiming he had already paid the dower in cash on the wedding night and that his wife had left voluntarily.
The High Court rejected the husband's argument, ruling that simply stating in court that dower was paid is not proof, he needed actual evidence, which he failed to provide. The court explained that dower is essentially a debt owed by the husband, and if it remains unpaid, the wife has the right to refuse to live with him and is still entitled to maintenance.
However, since the allegation of cruelty against the husband was not proven, the court ruled he was entitled to restitution of conjugal rights, but only once he actually pays the dower. The petition was dismissed on the dower and maintenance issues but partly allowed on conjugal rights, conditional on payment.
This ruling reinforces that unpaid dower gives wives a legitimate right to withhold cohabitation and claim support.
