Habib Bank LTD won in Unfair Labor Practice Case

PLJ 2013 · Sindh High Court

This case involved a bank employee, Rao Mazhar Ali Khan, who worked at Habib Bank Limited and also held a position as president of a workers union. The bank issued him a show-cause notice alleging that he had taken illegal gratification (bribes) in exchange for promising jobs at the bank to two individuals. Investigation showed that two complainants had transferred two million rupees into a bank account belonging to the employee's wife, supposedly in return for being helped into bank jobs. The employee denied wrongdoing, claiming his wife's account was independent of him and that the disciplinary action was actually retaliation for his union activities and participation in a labor referendum, amounting to unfair labor practice. He asked the National Industrial Relations Commission to stop the bank from taking any action against him.

The Commission examined the matter and found that the employee failed to explain why such a large sum of money had been transferred into his wife's account. It held that disciplinary action taken by an employer for suspected misconduct, such as taking bribes, is a normal managerial function and cannot automatically be treated as unfair labor practice just because the employee holds a union position. Since the employee did not establish a strong preliminary case, the Commission refused to grant a stay order protecting him from the bank's disciplinary proceedings.

This decision matters because it clarifies that labor law protections against unfair practices do not shield employees from legitimate disciplinary action, especially when there are credible allegations of financial misconduct like extorting money for jobs.
