Fundamental Right of Accused is Fair Trial

PLJ 2013 · Lahore High Court (Multan Bench)

This case involved a man on trial under narcotics laws before the Special Judge, Anti-Narcotics Force, Multan. During the trial, when two prosecution witnesses, including the investigating officer, appeared to give evidence, the accused's chosen lawyer was unavailable because he was engaged in another murder case. Instead of granting an adjournment, the trial court immediately appointed a different lawyer at state expense, who cross-examined the witnesses the same day without ever consulting the accused or studying the case file. When the accused later asked the court to recall these witnesses so his own lawyer could properly cross-examine them, the trial court refused.

The Lahore High Court (Multan Bench) found this unacceptable. It held that under Article 10(1) of the Constitution, every arrested or detained person has the right to a lawyer of their own choice, and under the newly added Article 10A, everyone is entitled to a fair trial and due process. The court also noted that Section 340(1) of the Criminal Procedure Code guarantees an accused the right to be defended by counsel. A court cannot force a different lawyer onto an accused who has already chosen one, since genuine representation is central to a fair trial.

The High Court allowed the petition, directing that the witnesses be re-summoned for proper cross-examination by counsel of the accused's choice, as a final opportunity. This judgment reinforces that the right to counsel of one's own choice is a core part of fair trial guarantees in Pakistan's justice system.

لاہور ہائی کورٹ (ملتان بینچ) نے اس طرزِ عمل کو ناقابلِ قبول قرار دیا۔ عدالت نے قرار دی
