Four witnesses must be produced to prove commission of Zina
PLJ 2013 FSC 75 · Federal Shariat Court
This case is about a false accusation of illegitimacy, which under Pakistani law counts as an accusation of zina (unlawful sexual relations), known legally as Qazaf. The complainant, Mst. Sajida Bibi, had been validly married and had a daughter, Fozia, who inherited property from her late father. The accused, Muhammad Ramzan, wanted to acquire this inherited land and, to challenge Fozia's legal right to it, filed a civil suit claiming she was not actually her father's legitimate child—implying her mother had committed zina.
Under the Offence of Qazf (Enforcement of Hadd) Ordinance, 1979, anyone who makes such an accusation must prove it by producing four witnesses, as required for proving zina itself. Ramzan could not produce these witnesses; he only made general denials during his trial statement and produced one unrelated witness. The trial court convicted him of Qazaf and sentenced him to eighty stripes as Hadd (the prescribed punishment).
On appeal, the Federal Shariat Court upheld this conviction. The judges found that Ramzan had fabricated the allegation purely to grab property, without any evidence, and had failed to meet the legal standard of producing four witnesses to support such a serious accusation. The court ruled the conviction was neither unfair nor excessive and dismissed the appeal, confirming the punishment.
This case matters because it reinforces that baseless accusations of zina—especially used as a tool in property disputes—carry serious legal consequences, and such cla
