Prosecution has to prove the case beyond any doubt
PLJ 2013 Cr.C. ( · Peshawar High Court
This case involved four people arrested when police stopped their car on the G.T. Road near Peshawar, allegedly acting on a tip that charas (hashish) was being smuggled towards Punjab. On searching the vehicle, police claimed to have found 100 kg of charas hidden in the rear seat and boot. Two men were sitting in front, and two women, one elderly and one young, were in the back seat. All four were charged and convicted under the Control of Narcotics Substances Act, 1997, and sentenced to life imprisonment.
The two women appealed, arguing they were merely passengers travelling for medical treatment, had no knowledge of any hidden drugs, and that the contraband was not found on their persons but concealed in secret compartments not visible to them. The men's own statements supported the claim that the women had simply boarded the car for treatment in Rawalpindi.
The Peshawar High Court accepted this defense. It found that the prosecution failed to prove the women knew about the narcotics, since nothing was in plain view and the drugs were recovered from hidden parts of the car, not from their direct possession. The court held that mere presence in a vehicle where contraband is later found is not enough to establish guilt; knowledge and conscious possession must be proved. Since the prosecution could not meet this burden, the appeal was allowed and the women's convictions were overturned. The judgment underscores that criminal guilt requires proof beyond reasonable doubt, not mere association or presence.
