No one shall be allowed to commit financial murder of another person
PLJ 2013 Cr.C. (Peshawar) 686 · Peshawar High Court
This case concerns a bail application filed by Muhammad Imran, who was accused of issuing a dishonoured cheque under Section 489-F of the Pakistan Penal Code. According to the complainant, the accused owed him Rs. 1,250,000 and had issued a cheque for that amount, which bounced because there was insufficient money in the account. Lower courts had already rejected the accused's bail requests, prompting this petition before the Peshawar High Court.
The petitioner argued he was a government servant whose job could be jeopardized, that there was no written proof of the loan, and that the offence did not fall under the strictest category of crimes where bail is normally denied. The State and the complainant opposed bail, pointing out that the accused admitted owning the bank account, had gone into hiding after the cheque bounced, and had not genuinely denied issuing it.
The High Court dismissed the bail application. It held that even though the offence wasn't in the category where bail is automatically barred, that alone doesn't guarantee bail—each case must be judged on its own facts. The judge emphasized that dishonoured cheques are a growing problem eroding public trust, and that issuing worthless cheques amounts to a kind of "financial murder" of another person. The court ordered the trial to be completed within four months, clarifying that its remarks were preliminary and shouldn't influence the actual trial.
