Khawaja Mateen V. The State

PLJ 2013 Cr.C. (Lahore) 994 · Lahore High Court

This case concerns a bail application filed by Khawaja Mateen Yousaf before the Lahore High Court. He had been arrested under Section 489-F of the Pakistan Penal Code, which deals with issuing a cheque that is dishonoured when the person had no intention of honouring it or insufficient funds in the account. The complainant alleged that he had given the petitioner over Rs. 64 lakh for business purposes, and while some amount was returned along with several cheques, one cheque worth Rs. 300,000 bounced.

The petitioner argued that this was essentially a business dispute between partners rather than a criminal matter, that he had no prior convictions, that investigation was complete, and that he had already secured bail in six similar cases filed by other business associates of the complainant.

The court agreed to grant bail. It relied on established legal principles: where a genuine business relationship is admitted between parties, bail should generally not be refused. It also noted that since the offence carries a maximum punishment of three years, it does not fall under the serious offences where bail is restricted, meaning bail is the normal rule rather than the exception. Considering the petitioner's clean record, completed investigation, and the business nature of the dispute, the court granted him bail upon furnishing bonds and a surety. This case illustrates how courts distinguish genuine business disputes from criminal fraud in cheque dishonour cases.
