Liberty of a Person is a precious right
PLJ 2013 Cr.C. (Lahore) 988 · Lahore High Court
This case involved a man accused of issuing a dishonored cheque, an offence under Section 489-F of the Pakistan Penal Code, which carries a maximum punishment of three years imprisonment. He had already been denied bail twice before, once withdrawn and once dismissed on merits, with the court at that time directing the trial court to finish the case within one month since most of the evidence had already been recorded.
More than four months passed and the trial still was not concluded. Instead of wrapping up, the prosecution filed a late application asking to call a bank officer as a new witness, a move the court saw as an attempt to drag out the proceedings rather than genuinely advance the case. Meanwhile, the petitioner, a retired army colonel, had already spent about 24 months in jail, despite the maximum possible sentence being only three years. The dispute itself stemmed from a joint business arrangement and payment disagreement between the parties.
The Lahore High Court held that since there was no realistic prospect of the trial concluding soon, and the accused had already served a period approaching the maximum sentence while merely awaiting trial, continuing his detention was unjustified. Emphasizing that personal liberty is a precious right that cannot be curtailed indefinitely, the court granted him post-arrest bail, subject to furnishing bail bonds and a surety. This case highlights how courts can intervene when prolonged pretrial detention becomes disproportionate to the possible punishment.
