Delay in FIR in 489-F matter
PLJ 2013 Cr.C. (Lahore) 484 · Lahore High Court
This case involves a man named Malik Irfan who was accused of issuing a dishonored cheque worth Rs. 200,000 under Section 489-F of the Pakistan Penal Code, which deals with cheques issued dishonestly without sufficient funds. He was arrested and sought post-arrest bail from the Lahore High Court.
His lawyer argued that there was an unexplained delay of five months and ten days between the alleged incident and the filing of the FIR, that the dispute was essentially a civil financial matter rather than a criminal one, that he had no prior criminal record, and that since the police investigation was already complete, there was no need to keep him in custody.
The court agreed with these arguments. It noted the significant, unexplained delay in registering the FIR and found that the underlying dispute appeared to be civil in nature. It also pointed out that since the maximum punishment for this offense does not exceed three years, the case did not fall under the stricter bail provisions reserved for more serious crimes. Citing earlier Supreme Court precedent, the judge noted that for offenses not punishable by death, life imprisonment, or ten years in prison, granting bail should be the normal rule rather than the exception.
As a result, the court granted bail, requiring the petitioner to submit bail bonds of Rs. 50,000 with a surety. This case illustrates how delays in filing FIRs and the civil nature of financial disputes can be significant factors favoring bail in cheque dishonor cases.
