Aslam Parvaiz V. The State

PLJ 2013 Cr.C. (Lahore) 1005 · Lahore High Court

This case involved Aslam Pervaiz, who was accused of issuing a dishonoured cheque worth Rs. 442,000 under Section 489-F of the Pakistan Penal Code, a crime related to fraudulent cheques. The cheque had reportedly been issued as part of a land purchase deal, but the land was never actually transferred to him.

The complainant's side argued that the petitioner should be denied bail because he had around 25 similar cases against him, suggesting he was a habitual offender, and that the land had instead been transferred to another person named Qamar supposedly on the petitioner's instructions.

The Lahore High Court disagreed with denying bail on these grounds. It noted that having other pending cases does not automatically disqualify someone from bail if they otherwise qualify on merit, and the petitioner had no prior convictions. Importantly, the sale deed produced in court showed Qamar, not the petitioner, as the buyer, and police had never recorded any statement from Qamar confirming he acted on the petitioner's behalf. The court also pointed out that this type of offence does not fall under the restrictive "prohibitory clause" that normally makes bail harder to get, and that the matter required further inquiry before guilt could be established.

As a result, the court granted bail, requiring the petitioner to submit bail bonds of Rs. 100,000 with one surety. This case illustrates how courts assess bail based on concrete evidence rather than general allegations or an accused's reputation.
