Constitutional Ejectment Petition
PLJ 2013 · Sindh High Court
This case concerned a dispute between a landlord and a shopkeeper over a rented shop in Sukkur. The landlord, Muhammad Rafi, claimed the petitioner was his tenant under a written rent agreement and sought eviction, partly to use the shop himself for his own business. The tenant, Muhammad Aslam, denied any landlord-tenant relationship with Rafi, claiming instead that he was a tenant of the Municipal Corporation on municipal land, with his own separate lease and rent arrangement with that authority. He argued the rent agreement produced by Rafi was fake. The Rent Controller ruled against the tenant, and the Appellate Court upheld that decision, though with some modification favorable to the tenant regarding his municipal allotment. The tenant then challenged this before the Sindh High Court under Article 199 of the Constitution.
The High Court dismissed the petition. It held that its constitutional jurisdiction is narrow: it cannot re-examine factual findings or act as a substitute for an appeal or revision, which are not available in such rent matters beyond the first appeal. The Court can only intervene if the lower courts acted without jurisdiction or their findings were legally perverse. Since the tenant had not challenged the appellate court's modified order and no jurisdictional error was shown, the Court upheld the eviction order.
This case matters because it clarifies the limited scope of High Court review in rent disputes, preventing such petitions from becoming backdoor appeals.
