Benefit extended to one employee is for all employees

PLJ 2013 · Islamabad High Court

This case involved seven employees of Allama Iqbal Open University who had been granted two advance salary increments back in 1986 for completing a Master's degree in Educational Planning and Management. Years later, an audit objection led the university to withdraw these increments and recover the money already paid. One affected employee, Muhammad Iqbal, challenged this withdrawal before the Federal Service Tribunal and won, on the grounds that the university had full authority over its own employees' pay and terms, and neither the Federal Government nor its Finance Division could override those decisions. The Supreme Court upheld this ruling when the matter was appealed. The petitioners in this case, who were in the same situation but had not been part of that original lawsuit, asked for the same treatment and refund, but the university refused, arguing they were not parties to the earlier case.

The Islamabad High Court ruled in favor of the petitioners. It held that once the Supreme Court decides a legal question, that ruling applies broadly and is binding on all courts, regardless of whether someone was an actual party to that specific case. The court also found that giving a benefit to one employee while denying the same benefit to other similarly situated employees violates the constitutional guarantees of equality and equal protection under the law (Articles 4 and 25). All seven petitions were accepted, meaning the employees were entitled to have their increments restored. This case matters because it reinforces that government and institutional bodies cannot treat similarly situated employees differently once a legal precedent has been set.
