The surety is confiscated if accused absconds
PLJ 2013 AJ&K 184 · Azad Jammu & Kashmir High Court
This case from the Azad Jammu & Kashmir High Court deals with what happens when a person who stood surety (guarantor) for an accused fails to produce that accused in court.
An accused facing trial for minor offences absconded and went abroad after someone (the respondent) had furnished a surety bond of Rs. 50,000 guaranteeing his appearance. When the accused could not be produced for nearly two years, the trial Magistrate forfeited the entire surety amount. On appeal, the Sessions Judge reduced the forfeited amount to Rs. 30,000. The surety's relative who had originally sought full forfeiture then challenged this reduction before the High Court, arguing the full amount should be confiscated since the surety had been given ample time and failed to comply.
The High Court upheld the Sessions Judge's reduced order. It explained that when forfeiting a surety bond under Section 514 of the Criminal Procedure Code, courts must strike a balance between being too harsh and too lenient. Noting that the accused had since surrendered and appeared before the court, and that the reduced amount had already been deposited in the government treasury, the Court found the Sessions Judge's order fair and just. It dismissed the petition seeking restoration of the full forfeiture.
This case matters because it illustrates how courts weigh fairness and proportionality when sureties fail to produce an accused, rather than automatically imposing the harshest penalty.
