Writ Petition dismissed when filed with delay of 4 years

PLJ 2012 · Lahore High Court (Multan Bench)

This case concerns a wife, Mst. Aamna Abdullah, who filed a family court suit against her husband seeking dissolution of marriage, dower, maintenance, and dowry articles. When reconciliation efforts failed, the Family Court in Multan granted her a divorce on the basis of khula (a wife-initiated divorce) but ordered her to return the dower she had received, Rs. 500 and five tolas of gold, as required under the law when a marriage ends in khula. This decree was passed on 31.1.2007.

The wife did not challenge this order for four years. In 2010, she finally filed a constitutional petition before the Lahore High Court, arguing that the order to return the dower was illegal since her husband had never specifically asked for it back, and that her delay in approaching the court should be excused because of bad legal advice and illness.

The High Court rejected her petition primarily on the ground of laches, meaning excessive, unexplained delay. It held that constitutional jurisdiction is an equitable remedy, and a party who sleeps on their rights for four years without adequate justification cannot expect relief. The court found her delay amounted to negligence and dismissed the petition without deciding the merits of her dower argument.

This case is a reminder that even valid legal grievances can be lost if not pursued promptly, since courts exercising constitutional/equitable jurisdiction expect timely action.
