Where end result is acquittal FIR should be quashed

PLJ 2012 · Peshawar High Court

This case involved a dispute between two doctors at a government hospital in D.I. Khan. Dr. Khalid Aziz Baloch, the Medical Superintendent, filed a police report (FIR) against Dr. Misal Khan and two others, accusing them of threatening him, forcing their way into the hospital's administration block, breaking a lock, damaging property, and stealing official documents. The background was a bitter rivalry between the two doctors over who should hold the post of Medical Superintendent, after Dr. Misal Khan was transferred out and had even challenged that transfer before a service tribunal, which had issued a status quo order in his favor.

Dr. Misal Khan and the other accused asked the Peshawar High Court to quash the FIR, arguing there was no real evidence against them and that the complaint was motivated by the ongoing transfer dispute rather than any genuine crime.

Additionally, the supposedly stolen official documents were never recovered from the accused. The court held that since there was no credible evidence to support the prosecution's case, continuing the trial would be pointless because it would inevitably end in acquittal. It therefore quashed the FIR entirely.
