PTCL V. ETO

PLJ 2012 Tax Cases (Kar.) 70 (DB) · Sindh High Court

PTCL, Pakistan's telecom company, challenged how the Sindh government was taxing its properties in Karachi under the province's Urban Immovable Property Tax Act, 1958. The dispute was simple in principle but had major financial consequences: should PTCL's buildings (like telephone exchanges) be taxed at the lower "industrial" property rate or the higher "commercial" rate under the tax authorities' valuation notification?

PTCL argued that since the Federal Government had officially declared telecommunications to be an "industry," its properties should automatically qualify for industrial tax rates. The provincial tax authorities disagreed, arguing that a federal policy label doesn't control how a provincial tax law classifies property, and pointed to earlier court rulings, including a Supreme Court decision, supporting their position.

The Sindh High Court sided largely with the tax authorities. It held that merely being part of an "industry" in a broad economic sense isn't enough to get industrial tax rates. What matters is whether actual industrial activity takes place on the specific property, something more than routine technical maintenance or servicing of equipment. Since there was no evidence on record showing such qualifying industrial activity at PTCL's properties, the court said they should generally be taxed as commercial properties.

However, the court didn't shut the door entirely. It directed that where PTCL believes genuine industrial activity does occur at a particular property, it can apply to the tax authorities with full details, allowing case-by-case reassessment. This clarifies that industrial tax status depends on actual
