Can the protective bail be granted without touching merits?
PLJ 2012 Tax Cases ( · Islamabad High Court
This case concerns a man named Muhammad Jamal who was outside Pakistan when a criminal case (FIR) was registered against him by Customs authorities in Karachi, alleging offences under the Customs Act, Sales Tax Act, and Income Tax Ordinance relating to tax and customs violations. Fearing arrest upon his return to Pakistan, he approached the High Court seeking what is called protective bail, essentially a short-term legal safeguard allowing him to travel back into the country and present himself before the trial court without being arrested immediately on arrival.
The court, without examining the actual merits of the criminal allegations against him, granted this protective bail for a limited period of 15 days. During this time, he was required to surrender before the trial court that would actually handle his case. The bail was conditional on him providing a solvent surety of one million rupees along with a personal bond of the same amount, to the satisfaction of the court. The judges made clear that this was a one-time concession: if he failed to surrender within the 15-day window, he would forfeit the surety money, and no extension would be granted regardless of circumstances.
This type of ruling matters because it illustrates how courts balance an individual's right to return home safely with the state's interest in ensuring accused persons face trial, using financial guarantees and strict deadlines rather than ruling on guilt or innocence at this stage.
