Co-sharers in Shamlat Deh Land cannot be dispossed unless partition suit

PLJ 2012 SC (AJ&K) 21 · Azad Jammu & Kashmir High Court

This case from the Azad Jammu & Kashmir Supreme Court dealt with a land dispute over shamilat-deh (village common) land in Kotli district. The plaintiffs, who owned shares in the village land, sued for declaration and possession, claiming certain defendants were illegally occupying and constructing a house on land identified as theirs. They sought a status quo order to stop construction while the case proceeded.

The trial court initially froze construction but then lifted that order after learning the defendants had become co-sharers in the shamilat-deh land themselves, having obtained a gift-deed from other co-owners during the lawsuit. The District Judge upheld this, but the High Court later reinstated the status quo order, reasoning that every member of the village's proprietary body has a stake in every part of the shamilat-deh land.

The Supreme Court disagreed with the High Court and ruled in favor of the appellants (the house-builders). It held that once someone becomes a co-sharer in shamilat-deh land, they cannot be dispossessed or barred from using their share simply through a civil suit for possession; this can only happen through a formal partition process. The court also found that the balance of convenience favored the appellants, especially since they had already invested heavily in construction and offered to demolish the house at their own cost if they ultimately lost the case.

This ruling matters because it protects co-owners of shared village land from being arbitrarily evicted without proper legal partition proceedings, reinforcing due process in property disputes involving common land.
