CORRUPTION IN PAKISTAN STEEL MILLS CORPORATION AND OTHERS MATTERS

PLJ 2012 SC 678 · Supreme Court of Pakistan

This Supreme Court of Pakistan case involved a suo motu inquiry, meaning the court took up the matter on its own initiative after a newspaper report revealed corruption and mismanagement at Pakistan Steel Mills Corporation during 2008-2009, which allegedly caused billions of rupees in losses to the government. The Chief Justice and two other judges examined whether officials had misused their positions and whether investigating agencies had properly looked into the allegations.

The judgment found that the Federal Investigation Agency and the Ministry of Industries failed to conduct a serious or professional investigation. Directors General of the investigating agency were repeatedly transferred before they could make progress, cases registered against accused persons resulted in bail with no effort made to cancel it, and a forensic audit report showing losses of over 26 billion rupees was ignored while the Ministry deliberated instead of acting. The court noted the agency could not even establish clear links between certain business dealings and the people who benefited from underpriced transactions with the Steel Mills.

The court discussed corruption broadly, citing constitutional duties of citizenship and the UN Convention against Corruption, emphasizing that corruption undermines democratic institutions, the rule of law, and economic stability, and that the state has a duty to investigate and prevent it effectively.

This case matters because it highlights how weak, obstructed, or half-hearted investigations allow massive public losses to go unpunished, and it underscores
