A murderer doesn't ordinarily carry weapon after 10 days

PLJ 2012 SC 44 · Lahore High Court

This case concerns a murder appeal before the Supreme Court of Pakistan. The appellant, Muhammad Nadeem alias Banka, was convicted of murdering a man named Tahir and sentenced to death under Section 302(b) of the Pakistan Penal Code. A co-accused was acquitted at trial. Both the trial court and later the Lahore High Court upheld his conviction, relying on eyewitness testimony, recovery of the murder weapon (a pistol), and an alleged motive.

The Supreme Court re-examined the evidence and found serious problems. The eyewitnesses were close relatives of the deceased, and while relationship alone doesn't discredit testimony, their accounts contained inconsistencies. More importantly, the Court found the alleged recovery of the pistol highly suspicious, noting that it made no logical sense for someone who committed murder to keep carrying the weapon around for 10 to 11 days before being arrested, rather than disposing of it quickly. The investigating officer and witnesses also gave contradictory accounts of where the arrest and recovery actually took place. The Court also questioned why an identification parade was held for a co-accused whose name and address investigators had apparently already learned.

Concluding that neither the eyewitness account nor the weapon recovery was free from doubt, and that the prosecution had failed to prove guilt beyond reasonable doubt, the Supreme Court gave the benefit of the doubt to the accused and allowed the appeal, overturning the death sentence.
