Masood Ahmad Bhatti V. Federation of Pakistan

PLJ 2012 SC 419 · Sindh High Court

This case concerns employees who originally worked for the government's Telephone and Telegraph Department, which was later converted into Pakistan Telecommunication Corporation and eventually privatized into Pakistan Telecommunication Company Limited (PTCL). Three employees had disputes with PTCL over matters like pensions, promotions, and a voluntary separation scheme. One of them had already won a case before the Service Tribunal, but PTCL did not implement that ruling.

When the employees went to the Sindh High Court seeking enforcement of their rights, the High Court dismissed their petitions, reasoning that PTCL's employment rules were not "statutory rules" and therefore courts had no jurisdiction to intervene under Article 199 of the Constitution.

The Supreme Court disagreed. It held that under the Pakistan Telecommunication Corporation (Reorganization) Act, 1996, employees who were transferred from the government corporation to the new company retained protection for their existing terms and conditions of service, which could not be changed to their disadvantage by either the company or the Federal Government. Because this protection stemmed directly from the law, the Court ruled these employees' terms of service were indeed governed by statutory rules. However, employees who joined PTCL after the transition did not have this same protection, since their employment was contractual.

The Supreme Court set aside the High Court's judgment and sent the case back for proper implementation of the employees' rights, reinforcing that transferred government employees retain legal protections even after privatization.
