Judgment under Islamabad Rent Restriction Ordinance 2001

PLJ 2012 SC 180 · Islamabad High Court

This case concerns a landlord-tenant dispute in Islamabad involving Shop No. 5 in the F-6/1 Farooqia Market. The landlords (respondents) filed an ejectment petition against the tenant, alleging he had defaulted on rent payments. The tenant denied there was a landlord-tenant relationship and argued the case was not valid, raising two key objections.

First, he argued the Rent Controller had no authority to hear the case because the ejectment petition was filed in January 2003, before the relevant notification bringing the area under the Islamabad Rent Restriction Ordinance took full effect in June 2004. Second, he claimed he was not actually occupying the shop himself; someone else was, so he shouldn't be liable.

The Rent Controller ruled against the tenant, and this was upheld by both the appellate court and later the Islamabad High Court. The Supreme Court, hearing the tenant's final petition for leave to appeal, also rejected his arguments. It held that since the Rent Controller gained jurisdiction while the case was still pending, and no unfairness resulted from this, the ejectment order was valid. It also found that the tenant himself was the one in possession of the premises, making him liable.

The Supreme Court refused leave to appeal, meaning the ejectment order against the tenant stood. The case clarifies how jurisdictional notifications under rent laws can apply to pending cases without causing injustice.
