Decision should be on merits
PLJ 2012 SC 174 · Islamabad High Court
This case involves a government employee, Syed Tahir Abbas Shah, who worked for the Oil and Gas Development Company Limited (OGDCL) and had a service-related grievance. He filed a constitutional petition in the Islamabad High Court seeking relief, but that court dismissed his petition, ruling that it had no jurisdiction over the matter and that he should instead approach the Federal Service Tribunal.
The Supreme Court disagreed. It traced through a series of earlier rulings dealing with the question of which forum, the High Court or the Service Tribunal, has jurisdiction over grievances of employees working in corporations connected to the federal government. The key principle that emerged is that if an employee's service conditions are governed by statutory rules, the High Court can hear their case under its constitutional jurisdiction. If, however, the employee's terms are governed only by contract or internal regulations rather than statutory rules, the ordinary master-servant principle applies and a different remedy is required.
The Supreme Court noted that in a related case involving OGDCL employees, it had already been held that OGDCL employees are governed by statutory rules, meaning the High Court, not the Service Tribunal, has jurisdiction over their grievances. Based on this, the Supreme Court found that the High Court's earlier dismissal was wrong, granted leave to appeal, and sent the case back to the Islamabad High Court to decide the petitioner's grievance on its actual merits rather than rejecting it on jurisdictional grounds.
