Quashment of NAB Proceedings Judgment
PLJ 2012 · Lahore High Court
This case from the Lahore High Court dealt with a challenge to accountability proceedings against directors of a private company (Classic Knit Wear) who had been accused under the National Accountability Bureau Ordinance, 1999 of "willful default" for failing to repay a loan of over Rs. 32 million taken from Pak Libya Holding Company for a garment project. The National Accountability Bureau (NAB) had filed a reference against them, and a trial court had refused to acquit them when they sought dismissal of the charges.
The petitioners argued that the legal procedure for initiating such cases had not been properly followed. Under the law and a Supreme Court ruling, two separate notices were required before prosecution for willful default could begin: first a 30-day notice from the financial institution, and then a separate 7-day notice from the Governor of the State Bank of Pakistan. The High Court found that these mandatory notice requirements had not been properly fulfilled in this case.
The court ruled that failing to follow this notice procedure made the entire case against the petitioners legally void from the start, and that this defect could not be fixed later. As a result, the court quashed the NAB reference and all related proceedings against the accused.
This case matters because it reinforces that procedural safeguards protecting the accused in accountability cases must be strictly followed, and shows that failure to do so can invalidate an entire prosecution, regardless of the underlying allegations.
